Application: MySievert — Medical Radiation Tracker
Company: Apex Technology Group, Inc. (“Apex,” “MySievert,” “we,” “us,” “our”)
By accessing, downloading, installing, or using MySievert (the “Service”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and Apex Technology Group, Inc. If you do not agree to any part of these Terms, you must discontinue use of the Service immediately and uninstall any associated applications.
Our Privacy Policy and our Consumer Health Data Privacy Policy are incorporated into these Terms by reference.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:
If you record procedures relating to another person — a child, a parent, or someone else in your care — you represent that you have the legal authority to do so, and you are solely responsible for that information and for any consequence of recording it. Those records are your account data. We do not know they exist and cannot separate them from your own.
MySievert is a personal record-keeping application. You tell it which medical procedures involving ionising radiation you have had, and when. It attaches a published reference dose value to each entry from a catalog of literature-derived figures, adds them up, and displays the running history back to you. It also lets you optionally enter your own procedure parameters if you happen to have the paperwork, in which case it uses those instead.
That is the entire function of the Service: storage, arithmetic, and display. Nothing more.
The Service is NOT intended to, and does not:
The Service is provided strictly for your own informational and personal record-keeping purposes.
MYSIEVERT DOES NOT PROVIDE MEDICAL ADVICE. NOTHING IN THE SERVICE IS MEDICAL ADVICE.
No content, figure, total, chart, colour, label, export, notification, help text, marketing statement, support reply, or any other output of the Service is, or should be construed as, medical advice, a medical opinion, a clinical judgment, a diagnosis, a prognosis, a treatment recommendation, a risk assessment, or the practice of medicine, radiology, medical physics, health physics, or any other licensed profession.
No professional relationship is created. Using the Service does not create a doctor–patient, clinician–patient, physicist–client, or any other professional relationship between you and Apex Technology Group, Inc., its personnel, or anyone associated with it. We are not your doctor. We are not anyone’s doctor.
Always consult a qualified professional. Questions about radiation exposure from medical imaging or treatment — including whether a study is appropriate for you, whether your cumulative exposure matters, and what any of it means for your health — belong with your physician, your radiologist, your radiation oncologist, or a qualified medical physicist or health physicist. They have your clinical context. This app has a list of dates and typical numbers.
Never disregard professional medical advice, and never delay seeking it, because of anything you have read or seen in the Service. If you think you may have a medical emergency, contact your local emergency services immediately.
This section exists because it is the single most important design commitment in the product, and we want it to be unambiguous rather than implied.
The Service does not interpret radiation dose. It has no clinical opinion, and it is built so that it cannot acquire one.
The Service does not, and is not designed to, tell you or imply that any dose or total is:
| safe · unsafe · dangerous · harmful · harmless | high · low · moderate · excessive · minimal |
| normal · abnormal · typical for you · unusual | elevated · within limits · over a limit · near a limit |
| concerning · reassuring · acceptable · unacceptable | a reason to act · a reason not to act · worth discussing |
Concretely, and by design, the Service contains:
Where the Service shades regions of a body diagram, that shading is a relative visual index of your own data and nothing else. It is normalised against the largest region in your own history, so the most-shaded region simply means “your biggest region,” whatever its magnitude. If your entire history is four dental X-rays, one of them will still be at the top of your own scale. The shading is not compared to any external reference, limit, guideline, or population value, and it does not indicate risk, safety, concern, or significance of any kind.
The diagram also shades where studies were aimed, which is not the same quantity as where dose was actually absorbed. Do not read it as an anatomical dose distribution.
Doses are displayed in millisieverts (mSv) or millirem (mrem) at your choice. These are units of measurement presented for record-keeping. Displaying a quantity is not the same as endorsing a meaning for it, and we endorse none.
Any conclusion you draw from what the Service displays is your own conclusion, reached without our input, and we accept no responsibility for it.
You are entitled to know exactly where the numbers come from, because it determines how little weight they can bear.
Unless you enter your own procedure parameters, every figure in your history is a published typical or representative dose for a procedure of that general type — not a measurement of what you received.
That is a deliberate product decision. Most people know they had “a CT of the head” and nothing more, and demanding contrast phases, scanner models, and dose-length products would produce an empty history that is worth nothing. So the app defaults to the most commonly performed variant and its typical published value, and lets you log in one tap.
The consequence is that a default figure can be off by a wide margin — potentially by a factor of several — from the dose you actually received. Real doses vary with the scanner, the protocol, the operator, the facility, your body size and habitus, the number of phases or acquisitions, the contrast used, the year the study was performed, and much else. None of that is known to the app unless you supply it.
If you hold a dose report or other paperwork, you may enter specific parameters — such as dose-length product, CTDIvol, kerma-area product, administered activity, or prescribed dose — and the app will use those instead. This generally produces a figure closer to your actual exposure, but it does not make the figure correct, verified, or clinically usable. Conversion coefficients are themselves published approximations that embed assumptions about anatomy and technique which may not hold for you.
Some catalog entries carry values that are interpolated or estimated rather than drawn from a specific published figure, and some values remain pending verification against their primary sources. Where the app can express uncertainty — as a range or a stated uncertainty on a record — that expression is part of the disclosure and should be read as such. An entry shown without a range is not thereby more reliable.
Cumulative totals are the arithmetic sum of the figures described above. Summing approximations does not produce a measurement, and a total carries all of the uncertainty of its parts. The Service’s separation of different categories of dose exists for record-keeping tidiness and is not a clinical or dosimetric standard.
WE MAKE NO REPRESENTATION OR WARRANTY OF ANY KIND REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, CURRENCY, OR CORRECTNESS OF ANY DOSE VALUE, TOTAL, CONVERSION, RANGE, OR OTHER OUTPUT OF THE SERVICE. WE DO NOT VOUCH FOR THE NUMBERS. YOU USE THEM AT YOUR OWN RISK.
Figures presented by the Service may be wrong for reasons including, without limitation:
We may correct, revise, supersede, or remove catalog values at any time. When we do, figures already in your history may change. That is a feature of keeping the reference data current and is not a defect, and we are not liable for any consequence of such a change.
Your own records are authoritative over ours. Where the app disagrees with a dose report from your imaging facility, the dose report is right and the app is wrong.
The Service is a personal notebook, not a medical record. It is not part of any legal medical record, is not maintained to any medical records standard, is not audited, is not attested, and is not verified against any source of truth. It is exactly as reliable as your memory and our typical values, which is to say: useful for keeping track, and not suitable for anything formal.
You must not use the Service or its outputs, and we do not authorise their use, as:
A PDF export from the Service is a convenience copy of your own notes. It is not certified, and its footer says so. Sharing it with a clinician is fine and often useful as a memory aid — but the clinician should treat it as patient-reported history, because that is what it is.
MySievert is not a medical device. It has not been cleared, approved, authorised, certified, registered, or evaluated by the United States Food and Drug Administration or by any other regulatory authority in any jurisdiction.
The Service transfers, stores, converts formats, and displays data. It does not interpret or analyse that data for the purpose of diagnosis, cure, mitigation, prevention, or treatment of any disease or condition, and it makes no claim about the clinical significance of any figure it shows. Sections 3, 4, 5, and 7 describe the intended use of the Service, and that intended use is record-keeping.
No statement in the Service, in our marketing, on our website, or by any of our personnel should be read as a claim of regulatory clearance, approval, or compliance. If you believe you have seen such a claim, tell us and we will correct it.
The Service’s reference catalog is compiled from published scientific and professional literature, including reports and guidance from bodies such as the National Council on Radiation Protection and Measurements, the International Commission on Radiological Protection, the American Association of Physicists in Medicine, professional societies in radiation oncology, brachytherapy, and dentistry, peer-reviewed journal articles, and manufacturer package inserts and regulatory labelling.
Apex Technology Group, Inc. and MySievert are not affiliated with, endorsed by, sponsored by, certified by, licensed by, or connected to any of these organisations, publishers, journals, authors, manufacturers, or any government agency.
If you need an authoritative figure, go to the primary source or to your imaging facility. Do not cite this app.
You must create an account to synchronise your history. You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity under your account. Notify us promptly of any unauthorised use.
You must provide accurate registration information and must not impersonate another person or create an account on behalf of someone else without authority. One account is for one person.
Because we hold no readable information about you, we cannot verify your identity by asking about your records. Account access is proven only through your sign-in provider. If you lose access to your sign-in provider account, we cannot transfer your data to a new one.
By using the Service, you acknowledge and accept that:
In exchange for accepting these risks, you get a guarantee that is otherwise unavailable: nobody at Apex, nobody who compromises our servers, and nobody who serves us with legal process can read your medical history. That trade is the product. We think it is the right trade, and we want you to make it knowingly.
You retain all rights in the records you create. You grant us only the narrow, non-exclusive licence necessary to store, transmit, and return your encrypted data so the Service can function — a licence that operates over ciphertext, because ciphertext is all we ever hold.
We receive no licence to use, read, analyse, publish, train on, sell, or exploit the contents of your health records, because we cannot read them and have made ourselves permanently unable to.
We do not use your data to train machine learning models. We could not, even if this agreement permitted it.
If you voluntarily send us feedback, suggestions, or bug reports, you grant us a perpetual, irrevocable, royalty-free licence to use them without obligation to you. Do not include your medical details in feedback.
You agree not to:
Security research. Good-faith security research that respects user privacy, avoids service degradation and data destruction, uses only accounts you control, and gives us reasonable time to remediate before disclosure is welcome and will not be treated as a violation of this section. Report findings to the address in Section 34.
The Service, including its software, design, interface, artwork, body diagrams, text, and the selection, arrangement, structure, and compilation of the reference catalog, is owned by Apex Technology Group, Inc. and protected by intellectual property law. The MySievert name and logo are our trademarks.
Individual numerical dose values derived from published literature are facts; our compilation, normalisation, structuring, and presentation of them is not. Nothing in these Terms transfers any ownership to you. You receive a limited, revocable, non-exclusive, non-transferable licence to use the Service for your own personal record-keeping.
Third-party components are used under their respective licences; notices are available in the application.
The Service may offer optional paid features. Where it does, purchases are processed by Google Play or the Apple App Store under that store’s terms. We never receive your payment card details.
The Service depends on third parties including Google Firebase Authentication, Google Play Services, Apple platform services, and our hosting provider. Their terms and privacy policies govern their own processing, and we are not responsible for their acts, omissions, availability, or changes in behaviour. See Section 9 of the Privacy Policy.
Apple and Google are not parties to these Terms, have no obligation to provide support for the Service, and are third-party beneficiaries entitled to enforce these Terms against you where their platform rules so require.
We may modify, suspend, add to, or discontinue any part of the Service, including the reference catalog and any feature, at any time, with or without notice. We may correct or supersede catalog values, which may change figures already in your history (Section 7).
If we discontinue the Service entirely, we will give reasonable advance notice through the app where we are able to, so you can export your history. Because we cannot read your data, we cannot export it for you. Export it yourself, and do not wait for a shutdown notice to start.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the Service.
On termination, your account record and encrypted blobs are deleted as described in the Privacy Policy, permanently and irrecoverably. Your local data on your device remains yours until you delete the app. Sections 4 through 10, 12, 13, 15, and 20 through 33 survive termination.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APEX TECHNOLOGY GROUP, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, such warranties are limited to the minimum scope and duration permitted by law.
You assume all risk arising from your use of the Service and from any reliance you place on its outputs.
You acknowledge and agree that you have not relied, and will not rely, on the Service or on any of its outputs in making any medical, health, treatment, screening, diagnostic, employment, insurance, legal, or financial decision, and that any such decision is yours alone, made with the benefit of qualified professional advice obtained elsewhere.
You further acknowledge that you have read and understood Sections 3 through 9, that you understand the default figures are typical published values rather than measurements of your own exposure, and that you understand the Service offers no interpretation of any kind.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APEX TECHNOLOGY GROUP, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This exclusion applies in particular to any claim arising from:
Aggregate cap. Our total cumulative liability for all claims relating to the Service shall not exceed the greater of (a) the total amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty United States dollars (US$50).
These limitations are a fundamental basis of the bargain between you and us, and apply even if a limited remedy is found to have failed of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, so some of the above may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded.
You agree to indemnify, defend, and hold harmless Apex Technology Group, Inc. and its officers, directors, employees, contractors, agents, licensors, and suppliers from any claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or relating to: your use or misuse of the Service; your breach of these Terms; your violation of any law or of another person’s rights; any decision made by you or by anyone else in reliance on the Service; and any records you enter concerning another person.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
Nothing in this section prevents you from reporting a concern to a government agency, or limits any non-waivable statutory right, including any private right of action provided by a consumer health data statute where such a right cannot lawfully be arbitrated or waived.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Where a dispute proceeds in court rather than arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware.
If you are a consumer resident in a jurisdiction whose law grants you mandatory protections that cannot be derogated from by agreement, nothing in this section deprives you of those protections or of the right to bring proceedings in the courts of your place of residence where the law so provides.
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labour disputes, governmental action, power or network failures, and failures of third-party platforms or providers.
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganisation, or sale of assets, subject to the commitments in the Privacy Policy.
We may revise these Terms. Material changes will be signalled by updating the effective date and, in the app, by notice before the change takes effect. Continued use after the effective date constitutes acceptance. If you do not accept a revision, stop using the Service and delete your account — but export your history first.
If any provision of these Terms is held invalid, illegal, or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall remain in full force and effect.
No failure or delay by us in exercising any right under these Terms operates as a waiver of it, and no single or partial exercise precludes any further exercise.
We may give notice through the application, or to the email address associated with your sign-in provider where one is available to us. You may give notice to apex@apextechnologygroup.io.
The Service contains cryptographic functionality and may be subject to export control laws. You represent that you are not located in, and are not a national of or ordinarily resident in, a country or territory subject to comprehensive sanctions, and that you are not on any restricted party list. You agree not to use or export the Service in violation of applicable export control or sanctions laws.
These Terms, together with the Privacy Policy and the Consumer Health Data Privacy Policy, constitute the entire agreement between you and Apex Technology Group, Inc. concerning the Service, and supersede all prior understandings. Headings are for convenience only. Where these Terms conflict with the Consumer Health Data Privacy Policy in respect of consumer health data, that policy controls.
